Damache v Minister for Justice, decided by the Supreme Court of Ireland on 10 February 2021 ([2021] IESC 6), was a constitutional challenge to section 19 of the Irish Nationality and Citizenship Act 1956, which deals with taking away citizenship from a naturalised person. The court considered two grounds. First, it ruled that revoking citizenship is not a judicial power but an executive power, though it can be reviewed by the courts. Second, it found the process used to revoke citizenship breached fair procedures because the minister controlled the steps, any challenges, and the final decision. The appellant therefore succeeded in the case.
