Blue Moonlight Properties 039 (Pty) Ltd v Occupiers of Saratoga Avenue and Another is a South African property law case heard by Judge Thokozile Masipa on 30 May 2008, with a judgment issued on 12 September. Blue Moonlight sought eviction under the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (PIE). The occupiers countered, asking the city to provide a report within two months detailing steps to offer them temporary emergency housing if evicted and to ensure access to adequate housing afterward, arguing there would be no lawful and affordable alternative accommodation available.

The occupiers tried to challenge the city’s involvement, but the court dismissed their in limine objection because an order joining the city had already been granted and could only be removed by a proper court. The city agreed to be joined on the condition it would argue the joinder issue later.

The court noted that PIE requires considering all relevant circumstances, which typically needs thorough input from the municipality. The city’s general report did not help the court in this case because it was not tailored to the Saratoga Avenue occupiers and lacked specific details. The court required concrete information about whether land could be made available for relocating the unlawfully occupying residents, not just generic statements. The city should investigate the situation and consult with stakeholders so the court could be properly assisted.

Ultimately, the court ordered the city to report within four weeks on the steps it had taken and could take to provide emergency shelter or other housing for the occupiers if eviction occurred. The case was postponed sine die (indefinitely).
