Justices of Appeal in Fiji
- They sit on the Court of Appeal and the Supreme Court, but not on the High Court.
- They are appointed by the President on the nomination of the Judicial Service Commission, which must consult the relevant Cabinet Minister and the parliamentary committee that oversees justice administration.
- Eligibility: must be a qualified barrister or solicitor with at least seven years’ experience in Fiji or another country allowed by law, or a former or current senior judicial officer in Fiji or another country allowed by Parliament.
- The judiciary can include non-citizens; judges from countries like the United Kingdom, Australia, and New Zealand have served in Fiji.
- Retirement: Justices of Appeal must retire at 70. Retirement can be waived for up to three years or for the length of one or more court sessions to allow continued service or a transfer to another judicial position, for up to three years. Waivers can be renewed, but not after age 75.
- No one may serve as a Justice of Appeal after age 78. Retired judges may be called back temporarily to fill gaps or cover for others when needed.
