On July 13, 2003, in San Jose, California, 25-year-old Bích Câu Tran was killed by a San Jose police officer inside her home on East Taylor Street. The incident led to protests by the Vietnamese American community who said the shooting was excessive force.
What happened
- Neighbors had reported Bích Câu yelling and wandering with her two young sons nearby. Her boyfriend, Đăng Quang Bùi, took her inside their apartment.
- When two San Jose police officers, Chad Marshall and Tom Mun, arrived, Bích Câu was in the kitchen holding a large vegetable peeler. Some accounts say she raised the utensil toward the officers; her family says she had already been angry and was trying to pry open a locked bedroom door.
- Within seconds of entering the home, Officer Marshall fired one shot into Bích Câu’s chest, killing her. A witness and officers described a chaotic scene, with Bích Câu’s sons crying nearby.
Background
- Bích Câu was born in Vietnam on May 2, 1978, and immigrated to the United States in 1997. She spoke little English and lived with her boyfriend and their two sons. She had a history of mental health issues and had sometimes stopped taking medication.
Aftermath
- A Santa Clara County grand jury reviewed the case but did not indict Officer Marshall for murder or manslaughter in October 2003.
- Bích Câu’s family filed a civil lawsuit against the city of San Jose and the officers. In 2005, the family was awarded about $1.825 million, with $800,000 of that going to her two sons.
- The shooting sparked protests and helped spur efforts by the Vietnamese American community to push for nonlethal policing and cultural sensitivity in law enforcement.
Legacy and impact
- The case contributed to the formation of advocacy groups such as the Coalition for Justice and Accountability, which pressed for changes in policing tactics.
- In 2015, California passed Senate Bill 227, which ended the use of grand juries to indict officers in fatal shootings. Since then, charging decisions in such cases are made by district attorneys.

- Bích Câu Tran was buried on August 2, 2003. The Bích Câu Tran Memorial Fund was established in her memory.
