North West Provincial Government: A Simple Guide

The North West Province in South Africa runs its government the way many parliamentary systems do. People vote for the North West Provincial Legislature, which has 33 members. After elections, the legislature chooses the premier, who leads the executive, and appoints a cabinet of ten ministers (MECs) who run the province’s departments.

Key roles
- The premier heads the provincial government and signs laws passed by the legislature. The premier can refer laws back for reconsideration if they think a law is unconstitutional, or send it to the Constitutional Court.
- The executive council (the premier and the MECs) implements laws and runs provincial departments. They carry out provincial policies in line with the national constitution.
- The legislature can force the premier to resign through motions of no confidence and can require changes to the cabinet. The premier is automatically a member of South Africa’s National Council of Provinces (NCOP) as the province’s representative.

Elections and lawmaking
- Members of the Provincial Legislature (MPLs) are elected every five years by party lists. Elections are run by the Independent Electoral Commission.
- The legislature can pass laws in areas such as health, education (excluding universities), agriculture, housing, environment, and development planning. Some powers are shared with the national government, while others are provincial-only.
- The legislature oversees the provincial administration and budget, and the premier and MECs must report on their work.

Judiciary and courts
- South Africa has a national court system. The province is planning to streamline the courts so there is a single High Court division in the area.
- The premier participates in the Judicial Service Commission on matters related to High Court judges in the province.
- The province is divided into 27 magisterial districts. District and regional magistrates handle most criminal cases, civil cases, and family matters, with different limits for fines and prison terms. The High Court handles appeals and constitutional questions.

Geography and local government
- The North West is made up of four district municipalities, which are divided into 18 local municipalities.
- Notable districts and towns include Dr Kenneth Kaunda (the smallest district) and Dr Ruth Segomotsi Mompati (the largest district). Rustenburg Local Municipality is the fastest-growing and most populous area, while Kagisano-Molopo is the largest local municipality by area within its district.
