Ex Parte Graham
Ex Parte Graham (1963) 4 SA 145 (D) is a South African case about inheritance when two people die in the same incident. A woman wrote a will saying her adopted son would inherit her estate when she died. If the son predeceased her, her mother would inherit instead. The woman and her adopted son died in a plane crash. The Registrar asked the court to declare that they died at the same time, and the court granted this. The case is important because it shows how SA law treats simultaneous death for inheritance and helps decide who gets the estate when a beneficiary dies in the same accident as the testator.
